These Terms of Use govern your access to and use of all services provided by Tunnelo, including this website, the Tunnelo SU SMS & USSD platform, and any custom software development engagements. By accessing our services, you agree to these terms in full.
1. Who We Are
Tunnelo is a product engineering studio based in Accra, Ghana. We design, build, and manage software products — including the Tunnelo SU SMS & USSD gateway, custom software development, and related digital services.

2. Acceptance of Terms
By accessing or using any Tunnelo service — including browsing this website, creating an account on the Tunnelo SU platform, submitting a project enquiry, or engaging us for software development — you confirm that:
- You are at least 18 years old or have the legal authority to enter into binding agreements on behalf of your organisation.
- You have read, understood, and agree to be bound by these Terms of Use.
- You accept our Privacy Policy as incorporated into these terms.
If you do not agree, you must stop using our services immediately.
3. Services Provided
Tunnelo provides the following services, each subject to additional terms where applicable:
3.1 Tunnelo SU — SMS & USSD Gateway
- Bulk SMS delivery to Ghanaian mobile networks and beyond.
- USSD session builder and hosting for interactive menu applications.
- Contact management, scheduled messaging, and delivery reporting.
- SMS credits purchased as bundles; credits are consumed per message sent.
3.2 Custom Software Development
- End-to-end design, development, and deployment of web and mobile applications.
- Ongoing management and maintenance of live systems.
- Agentic AI and automation systems.
3.3 This Website
- Informational content about Tunnelo and its products.
- Project enquiry forms and contact mechanisms.
4. User Accounts and Responsibilities
When you create an account on the Tunnelo SU platform:
- You are responsible for keeping your login credentials secure. Do not share your password.
- You are responsible for all activity that occurs under your account.
- You must provide accurate, current, and complete information at registration and keep it updated.
- You must notify us immediately at hello@tunnelo.click if you suspect unauthorised access to your account.
We reserve the right to suspend or terminate accounts that we reasonably believe are being used fraudulently, in violation of these terms, or in a manner harmful to other users or third parties.
5. Acceptable Use
You agree not to use Tunnelo services to:
- Send unsolicited bulk messages (spam) to recipients who have not consented to receive communications from you.
- Transmit content that is unlawful, defamatory, abusive, threatening, obscene, or otherwise objectionable.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorised access to any system, network, or data.
- Use the platform in any manner that violates the Electronic Communications Act, 2008 (Act 775) of Ghana or any applicable telecommunications regulations.
- Engage in phishing, fraud, or any activity that deceives recipients.
- Upload contact lists that contain data obtained without the consent of the individuals concerned.
- Reverse-engineer, decompile, or otherwise attempt to extract the source code of our platform.
Violation of these conditions may result in immediate account suspension, termination, and referral to the relevant authorities.
6. SMS Credits and Payments
6.1 SMS Bundles
- SMS credits are purchased in advance as bundles. Credits are deducted from your balance each time a message is successfully submitted for delivery.
- Purchased credits may be subject to an expiry period as stated at the time of purchase. Unused credits that expire are non-refundable.
- Tunnelo does not guarantee delivery of messages where the fault lies with the recipient's mobile network operator or where the recipient's number is inactive, invalid, or unreachable.
6.2 Custom Software Projects
- Fees for custom software development are agreed in a written project proposal or statement of work before work commences.
- Payment terms, milestones, and refund conditions are specified in the applicable project agreement.
- Where no separate agreement exists, payment is due in advance and is non-refundable once work has commenced.
6.3 Taxes
All prices are stated exclusive of applicable taxes unless explicitly noted otherwise. You are responsible for any taxes applicable to your use of our services in your jurisdiction.
7. Intellectual Property
All intellectual property rights in the Tunnelo website, the Tunnelo SU platform, and all associated software, designs, content, and trademarks are owned by or licensed to Tunnelo.
For custom software projects: unless explicitly agreed otherwise in a written project agreement, Tunnelo retains ownership of all code, designs, and deliverables until full payment is received, at which point ownership transfers to the client as specified in the project agreement.
You may not reproduce, distribute, or create derivative works from any Tunnelo property without our prior written consent.
8. Availability and Uptime
We aim to keep the Tunnelo SU platform available at all times, but we do not guarantee uninterrupted access. Scheduled maintenance, network issues, and circumstances beyond our control may cause temporary unavailability.
We will endeavour to notify users of planned maintenance in advance where possible.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- Tunnelo is not liable for any indirect, incidental, special, or consequential losses arising from your use of our services, including but not limited to lost revenue, lost data, or reputational damage.
- Our total aggregate liability to you for any claim arising out of or related to these terms or our services shall not exceed the amount you have paid to Tunnelo in the three months preceding the event giving rise to the claim.
- We are not liable for losses caused by third-party network operators, payment processors, or other external service providers outside our reasonable control.
10. Third-Party Services
The Tunnelo SU platform relies on third-party providers for SMS routing, USSD session management, and payment processing. By using our services, you acknowledge that:
- Your messages pass through third-party network infrastructure.
- Payment processing is handled by third-party payment providers subject to their own terms and privacy policies.
- We are not responsible for the acts or omissions of such third parties beyond our reasonable control.
11. Termination
You may stop using our services at any time. To close your account, contact us at hello@tunnelo.click.
We may terminate or suspend your access to our services immediately, without prior notice, if we determine that you have breached these Terms of Use or if we are required to do so by law.
On termination, any outstanding balances due to Tunnelo become immediately payable. Unused SMS credits remaining at account closure are non-refundable unless required by applicable law.
12. Changes to These Terms
We review and update these Terms of Use on the first day of each month. The "Last updated" date at the top of this page reflects the date of the most recent review. Continued use of our services after an update constitutes acceptance of the revised terms.
For material changes, we will notify registered users via email where reasonably practicable.
13. Governing Law and Disputes
These Terms of Use are governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Ghana.
